Chapter One: Introduction

1.1 Background of the Study
Terrorism has become a significant challenge in Nigeria, especially in the northeastern region, including Yobe State, where Damaturu LGA has been affected by the insurgency of Boko Haram (Adamu & Sani, 2023). The Nigerian Constitution enshrines the protection of national security and individual rights, but the growing menace of terrorism has tested the effectiveness of these provisions (Zubairu & Ibrahim, 2024). This study aims to examine how constitutional law can play a role in combating terrorism in Damaturu, focusing on the legal measures that address national security while balancing citizens' rights.

1.2 Statement of the Problem
Terrorism in Damaturu LGA has created widespread fear and disrupted daily life, leading to the displacement of people, loss of lives, and damage to infrastructure (Aliyu & Sani, 2023). The Nigerian Constitution contains provisions for protecting national security and curbing terrorism; however, these provisions have faced challenges in enforcement, and there is an ongoing need to balance security with the protection of fundamental human rights (Oluwaseun & Joseph, 2023). This study will investigate how constitutional law has been applied in the fight against terrorism in Damaturu and what improvements can be made.

1.3 Objectives of the Study

  • To evaluate the role of constitutional law in combating terrorism in Damaturu LGA.

  • To assess the challenges and gaps in enforcing constitutional provisions related to national security and counterterrorism in Damaturu.

  • To provide recommendations for improving the effectiveness of constitutional law in addressing terrorism.

1.4 Research Questions

  • How does constitutional law support the fight against terrorism in Damaturu LGA?

  • What are the key challenges in enforcing constitutional provisions related to terrorism and national security in Damaturu?

  • How can constitutional law be improved to better combat terrorism in Damaturu LGA?

1.5 Research Hypothesis

  • H₁: Constitutional law has had a limited impact on effectively combating terrorism in Damaturu due to enforcement challenges.

  • H₂: The balance between national security and human rights has been inadequately addressed in Damaturu's counterterrorism efforts.

  • H₃: Strengthening the application of constitutional law in security matters will improve counterterrorism efforts in Damaturu LGA.

1.6 Significance of the Study
This study will contribute to the understanding of the role constitutional law plays in combating terrorism in Nigeria. By focusing on Damaturu LGA, it will provide practical insights into how legal frameworks can be more effectively utilized to protect citizens and ensure national security.

1.7 Scope and Limitations of the Study
The study will focus on Damaturu LGA in Yobe State and will evaluate the role of constitutional law in counterterrorism efforts. Limitations include the sensitive nature of the subject, challenges in accessing data due to security concerns, and potential bias in official narratives regarding counterterrorism operations.

1.8 Operational Definition of Terms

  • Terrorism: Acts of violence or threats intended to cause fear and destabilize society, often perpetrated by extremist groups.

  • Constitutional Law: The legal framework established by the Nigerian Constitution for protecting national security and fundamental human rights.

  • National Security: The protection of the state and its citizens from external and internal threats, including terrorism.
